1. Acceptance of Terms

By booking or participating in any service with Local Surf Maroc SARL (“the Company”), the Guest agrees to these Terms and Conditions.
Acceptance of these Terms confirms that the Guest is of sufficient legal age to enter into binding contracts and assumes responsibility for all members of their booking group.

The Guest agrees to indemnify and hold Local Surf Maroc SARL harmless from any claims, losses, or damages arising from use of this website or participation in any service.
Failure by the Company to enforce any part of these Terms at any time does not constitute a waiver of any rights.

It is the Guest’s responsibility to review the most recent version of these Terms before departure via the official website.

2. The Guest and the Contract

The “Guest” is the individual whose name appears on the booking confirmation. For group bookings, the lead guest acts as the representative and accepts full responsibility for payment, communication, and compliance for all group members.

A non-binding reservation begins once a booking form is received. The contract becomes binding upon receipt of a deposit.
The Company reserves the right to refuse any booking at its sole discretion.

3. Prices and Currency

All prices are listed in Euros (€) unless otherwise stated.
Local Surf Maroc SARL is not responsible for exchange rate variations, bank transfer fees, or international transaction charges.
Discounts or promotional offers cannot be applied retroactively after booking confirmation.

4. Payment Terms

Surf Experiences and Retreats

  • A 20% non-refundable deposit is required to secure a booking.

  • The remaining balance is due on arrival, payable by cash or bank transfer.

  • Bank and exchange fees are the Guest’s responsibility.

Drop-In Lessons and Surf Guiding

  • Full payment must be received prior to the lesson or session.

  • For lesson or session packs of 3 and 5 lessons, minimum 50% deposit required

  • Sessions are non-refundable but may be rebooked once within 30 days, subject to availability.

Online Coaching and Video Analysis

  • Full payment is required to confirm any online coaching session.

  • Sessions are non-refundable.

  • Session validity: 1 session = 7 days; 3 sessions = 14 days; 5 sessions = 21 days from purchase.

5. Deposits, Changes, and Cancellations

Deposit Conditions

  • Minimum deposit: 20% of total booking value.

  • Deposits are strictly non-refundable.

  • Proof of transfer (screenshot or receipt) must be provided to confirm booking.

  • One date change is allowed free of charge up to 3 months before arrival.

  • Additional date changes: €50 per person (up to 3 total).

  • From the fourth change onward: €100 per person.

  • After five changes, Local Surf Maroc SARL may consider the booking cancelled.

Refund Policy

If cancellation occurs after more than the deposit has been paid, the following applies:

  • More than 100 days before arrival – Full refund (excluding deposit).

  • 60–99 days before arrival – 50% refund (excluding deposit).

  • 31–59 days before arrival – 25% refund (excluding deposit).

  • 30 days or less before arrival – No refund.

Cancellations must be communicated in writing via email.
“No-shows” or failure to arrive without notice will result in full payment due and no refund.

Company Cancellations

In the unlikely event that Local Surf Maroc SARL must cancel or significantly alter a booking, Guests will be notified as soon as possible and offered:

  • An alternative of equal or greater value, or

  • A full refund of all payments made (excluding force majeure events).

6. Force Majeure

Local Surf Maroc SARL shall not be liable for failure or delay in performance due to events beyond its reasonable control, including but not limited to:

war, strikes, civil unrest, terrorism, natural disasters, epidemics, pandemics, extreme weather, governmental restrictions, or transport disruptions.

In such cases, deposits will be held as a credit valid for 12 months from the original booking date.

7. Age and Consent

Guests must be 18 years of age or older to make a booking.

Guests under 18 must provide written consent from a parent or legal guardian before participating in any surf activity.

Parents or guardians accept full responsibility for the minor’s participation, conduct, and safety.

8. Conduct and Participation

Guests are expected to behave respectfully toward staff, fellow guests, and the local community.

Instructions from Local Surf Maroc SARL coaches or staff must be followed at all times to ensure safety.

Disruptive, unsafe, or disrespectful conduct may result in termination of the booking without refund.

Guests are liable for any damage to accommodation, vehicles, or equipment caused by negligence or misconduct.

9. Transport and Transfers

Complimentary transfers are provided for stays of five days or longer between:

  • Agadir Airport, or

  • Agadir Bus Station, and the accommodation.

Transfers outside these points or additional journeys are subject to separate charges.

Combined transfers for multiple guests may involve short waiting periods.

The Company is not liable for delays, cancellations, or expenses arising from third-party transport providers or force majeure events.

10. Risk Acknowledgement and Limitation of Liability

Surfing and ocean-based activities carry inherent risks, including physical injury or death.

By participating, Guests acknowledge and accept these risks and agree not to hold Local Surf Maroc SARL, its owners, staff, or contractors liable for any loss, injury, or damage, however caused.

The total liability of Local Surf Maroc SARL shall not exceed the total amount paid for the booking.

11. Medical and Risk Declaration

All Guests must complete and sign a Medical and Risk Acknowledgement Form prior to participation in any surf or related activity.

Failure to do so may result in refusal of participation without refund.

Guests are required to disclose any medical condition that may affect their ability to participate safely, including but not limited to: injuries, chronic illnesses, mental health conditions, or pregnancy.

12. Insurance, Passports, and Visas

Guests are fully responsible for obtaining adequate travel, health, and surf accident insurance before arrival.

Proof of insurance may be requested.

The Company accepts no liability for loss, damage, or costs incurred due to inadequate insurance coverage.

Guests must carry a valid passport and obtain all required visas before entering Morocco.

13. Physical Conditions and Weather

Surf and weather conditions are beyond the control of Local Surf Maroc SARL.

The Company reserves the right to modify or cancel activities if conditions are deemed unsafe or unsuitable.

No refunds are offered for weather-related disruptions; however, an equivalent alternative activity may be provided when available.

14. Guest Property and Equipment

All guest property is the sole responsibility of the Guest.

The Company is not liable for theft, loss, or damage of personal belongings.

Accommodation is lockable and equipped with secure storage areas, which Guests are encouraged to use.

Surf equipment provided by the Company must be used responsibly. Guests are liable for damage or loss caused by misuse or negligence.

15. Third-Party Suppliers

Some services (including excursions, transport, and rentals) may be provided by independent third parties.

Local Surf Maroc SARL acts solely as an intermediary and accepts no liability for the acts, omissions, or negligence of these providers.

16. Health and Fitness

Guests are responsible for ensuring they possess an adequate level of physical fitness to participate in surfing and related activities.

The Company reserves the right to deny participation if a Guest is deemed unfit, unsafe, or under the influence of alcohol or drugs.

Medical costs incurred during participation are the sole responsibility of the Guest.

17. Use of Images and Likeness

Photographs and video recordings may be taken during surf lessons, camps, or events for promotional and educational use.

By participating, Guests grant Local Surf Maroc SARL unrestricted rights to use such material in marketing, print, or digital formats.

Guests who do not wish to appear in such materials must notify the Company in writing before participation.

18. Privacy and Data Protection

Local Surf Maroc SARL collects personal data solely for booking, operational, and communication purposes, in compliance with applicable data protection laws, including GDPR.

Personal information will not be shared with third parties except when required to deliver contracted services or comply with law.

Guests may request access to, correction of, or deletion of their data at any time via hello@localsurfmaroc.com.

19. Complaints and Dispute Resolution

If any issue arises during a Guest’s stay, it must be reported immediately to a member of staff so that corrective action can be taken.

If unresolved, the Guest must submit a written complaint within 14 days of departure.

The Company will respond in writing within 30 days in an effort to reach a fair resolution before legal action.

20. Governing Law and Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of the Kingdom of Morocco.

The competent courts of Agadir, Morocco, shall have exclusive jurisdiction over any disputes arising from or relating to this agreement.

21. Contract Language

These Terms and Conditions are written in English.

In the event of any inconsistency between translated versions, the English version shall prevail.
