Local surf maroc booking terms & conditions

  1. Acceptance of booking conditions

    1. By accepting these booking conditions the Guest confirms that they are of sufficient legal age to use this website and to create binding legal obligations for any liability that may incur as a result of the use of this website. 

    2. The Guest also agrees to indemnify and hold Local Surf Maroc harmless from any loss, liability, claim or demand, including reasonable attorney’s fees, made by any third party due to or arising out of the use of the website. 

    3. Local Surf Maroc’s failure, at any time or for any period, to enforce any one or more of these terms, this shall not be a waiver of the remaining terms and conditions. 

    4. It is the guest’s responsibility to check the current terms and conditions before departure to their destination by visiting our website. 

  2. The Guest

    1. The person whose name and other particulars are used in communication and to make the contract with. In this document that person is described as “the guest”. 

  3. The Contract

    1. The Guest’s contract is with Local Surf Maroc. The person who signs the booking form and/or pays the deposit must read and accept these booking conditions.

    2. In the case of a group booking, the group leader agrees to take responsibility for signing on behalf of all group members. The group leader agrees to be responsible for the full cost of the holiday including additional insurance, cancellations and alteration fees. 

    3. A non-binding contract is initiated once the booking form is received by Local Surf Maroc. Local Surf Maroc reserves the right to refuse bookings, at our sole discretion, and without reason. 

    4. The contract becomes binding once a deposit is paid. Please inform Local Surf Maroc immediately if there are any discrepancies in the cost or details of the booking.

    5. Local Surf Maroc holidays start and end where indicated on the guest’s invoice or booking confirmation. 

  4. Personal Information

    1. All personal information including name, contact number & email address is used solely for communicating and booking with Local Surf Maroc and will not be disclosed to anyone outside of Local Surf Maroc without prior permission.

  5. Prices

    1. All prices are in Euros. 

    2. Local Surf Maroc is not responsible or liable for the changing value of exchange rates or bank fees that the guest may incur to complete payment of their contract. 

    3. Discounts offered by Local Surf Maroc cannot be applied retroactively after the booking has been made.

  6. Payment

    1. For Surf Experiences and Retreats hosted by Local Surf Maroc

      1. The contract between Local Surf Maroc and the guest becomes binding once a deposit has been received. 

      2. Bank transfer is the preferred method to receive the deposit

      3. Exchange fees and transaction fees are to be paid by the guest. 

      4. The deposit is non-refundable, regardless of when cancellation occurs. 

      5. The remaining balance is required no later than  on the date of arrival. Cash is the preferred methods of payment, but bank transfer is also accepted

    2. For Drop In Surf Lessons and Surf Guiding, and Surf Clinics hosted by Local Surf Maroc

      1. Payment must be received in full prior to any Drop In Surf Lesson, Surf Guiding, or Surf Clinics

      2. Bank transfer is the preferred method to receive payment

      3. Surf Lesson and Surf Guiding is non-refundable but can be rebooked for up to 30 days

      4. Surf Clincis are non-refundable but balance can be transferred to other Surf Lessons or Surf Guiding

    3. For Online Surf Coaching and Online Video Analysis

      1. First online surf coaching session is free.

      2. Payment for subsequent online coaching is required in full prior to a session

      3. An online surf coaching session is confirmed once payment has been received

      4. No refunds available for online surf coaching

      5. Buying 1 online session is valid for 10 days after purchase

      6. Buying 3 online sessions are valid for 20 days after purchase

      7. Buying 5 online sessions are valid for 30 days after purchase

  7. Deposit Conditions 

    1. A minimum of a 20% deposit is required to book any Surf Experience or Retreat

    2. Deposits are non-refundable

    3. Once a bank transfer has been completed, Local Surf Maroc requires proof of transfer

    4. If a 20% deposit is received, changes to booking dates can be made up to 3 months of the original arrival date. 

    5. If a 30% deposit is received, changes to booking dates can be made up to 4 months of the original arrival date. 

    6. If a 40% deposit is received, changes to booking dates can be made up to 5 months of the original arrival date. 

    7. If a 50% or more deposit is received, changes to booking dates can be made up to 6 months of the original arrival date. 

    8. Local Surf Maroc grants 1 changes of holiday dates prior to initiating a rebooking fee:

      1. Each subsequent date change requires a €50 per person per change up to 3 changes.

      2. From 3 changes onwards the rebooking fee is €100 per person per change 

    9. 5 changes of holiday dates, Local Surf Maroc reserves the right to initiate the cancellation clause of the contract.

  8. Changes

    1. It is unlikely that Local Surf Maroc will need to make changes to your holiday or online surf coaching session, but occasionally circumstances out of our control occur and changes may occur. 

    2. Therefore, Local Surf Maroc reserves the right to make changes at any time before and during your stay with us. This includes accommodation, itinerary, meals, and transportation. 

    3. Local Surf Maroc will endeavour to contact the guest in a timely manner, however, Local Surf Maroc is not under any obligation to. 

    4. An equivalent or higher value option will be selected and provided by Local Surf Maroc should any changes be required.

  9. Cancellation 

    1. Local Surf Maroc reserves the right to cancel your booking for any reason. 

    2. Local Surf Maroc will not cancel your booking less than 6 weeks prior to the scheduled departure except for reasons of force majeure such as war, political unrest, strikes, acts of God, epidemics, pandemics, natural and technical disasters, closure of ports and airports, or if the the guest fails to pay the balance of the travel price. 

    3. In the event of Local Surf Maroc being unable to fulfill the conditions that the guest has booked, Local Surf Maroc will provide an alternative booking arrangement of equivalent or higher value.

    4. With a generous deposit and rebooking option we hope that cancellation is never required, but can appreciate that circumstances may change last minute. If you are required to cancel your holiday for any reason, please contact Local Surf Maroc immediately. 

    5. Should the booking payment be made above the deposit by the guest, the following cancellation clause will be applied, however deposits remain non-refundable.

      1. Cancellations made within:

        1. 0 to 25 days prior to arrival will result in no refund.

        2. 26 to 50 days prior to arrival will result in 10% refund

        3. 51 to 75 days prior to arrival will result in 20% refund

        4. 76 to 100 days prior to arrival will result in 30% refund

        5. 101 days or longer, full refund will be issued

    6. Should a cancellation be made by the guest and only the deposit has been received, the deposit will remain non-refundable and the following cancellation clause will be applied.

      1. Cancellations made within:

        1. 0 to 25 days prior to arrival, 100% of the holiday will be charged

        2. 26 to 50 days prior to arrival, 90% of the holiday will be charged

        3. 51 to 75 days prior to arrival, 80% of the holiday will be charged

        4. 76 to 100 days prior to arrival, 70% of the holiday will be charged

        5. 101 days or more, no part of the holiday will be charged.

    7. If a no show should occur, full payment is required and no refund will be issued. 

  10. Directions & Instructions

    1. The Guest must follow all directions and instructions from Local Surf Maroc’s staff

    2. A Guest must not disturb other participants or guests, or interfere with the Local Surf Maroc’s staff’s ability to conduct any activities provided by Local Surf Maroc safely and securely.

    3. Failure to comply, at Local Surf Maroc’s discretion, may result in termination of the contract or refusal to allow participation in activities

  11. Termination & Refusal

    1. During a stay at Local Surf Maroc, Guests are expected to behave in an orderly and acceptable manner. Guests are expected to take responsibility for their behaviours and/or their group.

    2. Should a Guest’s behaviour endanger the condition of the accommodation, vehicles, equipment, staff, or seriously affect the comfort and wellbeing of other Guests, Local Surf Maroc reserves the right to refuse further acceptance of the Guest and to terminate any contractual obligations

    3. The Guest is liable for any damages incurred. 

    4. Local Surf Maroc reserves the sole and exclusive right, at its absolute discretion, to refuse any person, including the Guest, for any reason to participate in any Local Surf Maroc service, whether that person has previously paid for a Local Surf Maroc service or not. 

  12. Transport & Transfers

    1. Local Surf Maroc provides transfers to and from the following destinations as part of holiday packages 5 days or longer, at no extra cost:

      1. Agadir Airport

      2. Agadir bus station

    2. Local Surf Maroc is not responsible for the guest’s trip to or from any other destination, for any expenses, including travel, accommodation, subsistence and/or loss of earnings caused by late return to your point of departure, however caused. 

    3. Should Local Surf Maroc provide assistance to arrange travel to the accommodation, Local Surf Maroc cannot be held responsible or liable for any extra expenses or damages occurred, however caused. 

    4. Local Surf Maroc is not responsible for delays or cancellations to or from connections or other points of arrival or departure, however caused. 

    5. It may be necessary to combine the transfers of customers arriving or departing on more than one flight or bus route, which may require additional waiting times at the accommodation and/or airport and/or bus station. 

    6. Should Local Surf Maroc’s airport or bus station transfers be outsourced, no extra cost will be incurred, however, we can not be held responsible for any delays, extra expenses, or damages incurred during transport. 

    7. Please note that departure times are approximately 3 hours from your accommodation prior to your departure from the airport and 2 hours from your departure from the bus station.

  13. Risk Acknowledgement

    1. Each Guest participates in Local Surf Maroc holidays and activities at their own risk.

    2. The Guest acknowledges that there are inherent dangers both apparent and hidden associated with surfing, associated surf camps, and surf camp related activities which the Guest cannot hold Local Surf Maroc liable for. 

    3. To the full extent permitted by law, Local Surf Maroc is excluded from any liability to the Guest and will not be responsible for any loss, damage, injury, or death to the Guest arising from or connected with any activity conducted by Local Surf Maroc, however caused. 

    4. With the Guest’s participation in surfing, associated surf camps, and other associated activities the Guest acknowledges that loss, injury, or death may occur which the Guest cannot hold Local Surf Maroc responsible or liable for, however caused. 

    5. In particular, Local Surf Maroc is not responsible for any loss, damage, injury, or death to a Guest arising from from or relating to

      1. The Guest’s failure or refusal to obey an instruction from a instructor of Local Surf Maroc

      2. The Guest’s failure or refusal to impart any medical condition, including but not limiting to: previous injury, pregnancy, chronic medical condition, mental health condition

    6. Local Surf Maroc is not responsible for any loss or damage to the Guest or any of the Guest’s property arising from any negligent act by the Guest or other persons they come in contact with

  14. Insurance

    1. Insurance for travel, health, sport and/or equipment is not included in the holiday price of Local Surf Maroc. 

    2. The Guest is responsible for their own travel, health, sport, and/or equipment insurance when booking with Local Surf Maroc.

    3. Local Surf Maroc accepts no liability for loss or damage during the Guest’s stay.

  15. Passport & Visa

    1. It is the responsibility of each Guest to carry a valid passport and/or to obtain the appropriate visas when travelling

  16. Physical Conditions

    1. The Guest acknowledges and agrees that Local Surf Maroc has no control in respect of the weather, surf or other physical conditions during their holiday with Local Surf Maroc. 

    2. Local Surf Maroc is accordingly not liable for any loss, damage, inconvenience to any Guest or any property of any Guest arising from any or all of these factors.

    3. Local Surf Maroc reserves the sole and exclusive right to decide whether beach conditions, weather or other factors make any particular activity on a Local Surf Maroc booking unsafe or inadvisable. Thus, Local Surf Maroc May terminate any activity at any time without refund. An activity of equal or greater value may be offered by Local Surf Maroc if available, but Local Surf Maroc is under no obligation to provide one or a refund.  

  17. Guest Property

    1. Local Surf Maroc guarantees that its properties are locked entering and leaving the premises each time

    2. Local Surf Maroc rooms are lockable

    3. Local Surf Maroc premises provide adequate storage for surf, yoga, and personal effects and it is up to the Guest’s discretion to use these properly

    4. Every Guest is solely responsible and liable for the safekeeping of all the property of the Guest. 

    5. Local Surf Maroc has no responsibility for any loss through left, breakage, or otherwise of any property of the Guest.

  18. Equipment & Property

    1. Local Surf Maroc endeavours that adequate equipment is made available for activities directly provided

    2. In the case that activities are outsourced, Local Surf Maroc is not responsible or liable for the condition of the equipment

    3. Local Surf Maroc acknowledges that with wear and tear, equipment can break. However, the Guest is responsible for the condition of the equipment and is liable for any loss or damage.

    4. Guests are expected not to damage, deface, or remove any object, accommodation or equipment during their holiday with Local Surf Maroc

  19. Health & Fitness

    1. It is the responsibility of every Guest to ensure that they have an appropriate level of fitness to participate in Local Surf Maroc holidays and/or activities

    2. Local Surf Maroc reserves the right, at its sole discretion, to require any Guest to undergo any test to assess whether the Guest is capable of participating in any Local Surf Maroc holidays and/or activities. 

    3. The Guest must declare any underlying medical conditions which may or may not prevent the Guest from undertaking any activity or holiday service provided by Local Surf Maroc, including but not limited: acrophobia, epilepsy, diabetes, dizziness, limb or back injury, angina or other heart conditions, asthma, visual impairment, depression, anxiety, or recovering from recent surgery

    4. It is the Guest’s responsibility to consult with their Family Doctor, General Practitioner, and/or Physician for specific health recommendations for travel, activity participation, and/or underlying health conditions

    5. The Guest has the responsibility to inform Local Surf Maroc at the earliest possibility of any changes to their physical and mental health, and any underlying medication condition

    6. Local Surf Maroc reserves the right to request a recent and updated medical certificate stating that Guests are eligible to travel and/or participate in activities with underlying health conditions

    7. All medical costs or associated costs during a Guest’s holiday and/or activity are the responsibility of the Guest
